Welcome to discords.bot! These Terms of Service ("Terms") govern your access to and use of our Discord bots, including StickyBot and other services provided through discords.bot (collectively, the "Services"). • You have the authority to bind your Discord server to these Terms
• You will comply with all applicable laws and regulations
• You will not use our Services for any illegal or unauthorized purpose

3. Description of Services

discords.bot provides Discord bots that offer various functionality for Discord servers, including but not limited to:

• Sticky messaging services
• Message rotation and template management
• Webhook management
• Custom embed creation
• Premium subscription features

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice.

4. User Responsibilities and Acceptable Use

4.1 Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use our Services to violate any laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Transmit any harmful, offensive, defamatory, or inappropriate content
• Attempt to gain unauthorized access to our systems or Services
• Interfere with or disrupt the integrity or performance of our Services

5. Premium Subscriptions and Payments

5.1 Subscription Plans

We offer premium subscription plans that provide access to additional features and functionality. Subscription terms, pricing, and features are subject to change at our discretion, with reasonable notice to existing subscribers.

5.2 Billing and Auto-Renewal

Premium subscriptions are billed on a recurring basis (monthly or annually, as selected). By purchasing a subscription, you authorize us to charge your payment method on a recurring basis until you cancel your subscription. Subscriptions automatically renew unless canceled before the end of the current billing period.

5.3 Payment Processing

Payments are processed by Stripe, a third-party payment processor. You agree to provide accurate and complete payment information. You are responsible for all charges incurred under your account, including applicable taxes.

5.4 Subscription Cancellation

You may cancel your subscription at any time through your dashboard or by contacting support. Cancellation will take effect at the end of your current billing period. You will continue to have access to premium features until the end of the billing period for which you have paid.

5.5 Price Changes

We reserve the right to modify subscription prices at any time. Price changes will not affect your current subscription period but will apply to subsequent renewal periods. We will provide reasonable notice of any price changes via email or through our Services.

6. Intellectual Property

All content, features, and functionality of our Services, including but not limited to software, code, designs, text, graphics, logos, and trademarks, are owned by discords.bot or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you create or upload through our Services. By using our Services, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of providing and improving our Services.

8. Service Availability and Modifications

We strive to maintain high availability of our Services, but we do not guarantee uninterrupted or error-free operation. We reserve the right to:

• Limit access to certain features or services
• Terminate or restrict access for users who violate these Terms

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISCORDS.BOT AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless discords.bot and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of our Services
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you create, upload, or transmit through our Services

12. Termination

12.1 Termination by You

You may stop using our Services at any time by removing our bots from your Discord server and canceling any active subscriptions.

12.2 Termination by Us

We may terminate or suspend your access to our Services immediately, without prior notice, for any reason, including but not limited to:

• Violation of these Terms
• Illegal or fraudulent activity
• Non-payment of subscription fees
• Abuse of our Services or systems
• Extended periods of inactivity

12.3 Effect of Termination

Upon termination, your right to use our Services will immediately cease. We may delete your data in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination will survive, including but not limited to Sections 6 (Intellectual Property), 9 (Disclaimer of Warranties), 10 (Limitation of Liability), 11 (Indemnification), and 13 (Governing Law).

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. For users in the European Union, these Terms shall be governed by the laws of the European Union.

13.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or our Services shall first be addressed through good faith negotiations. If such negotiations are unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. You agree to waive your right to a jury trial and to participate in class action proceedings, except where such waiver is prohibited by law.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our Services after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using our Services.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and discords.bot regarding your use of our Services.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

15.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, or internet failures.
